Sir Marcus Smith was called to the Bar in 1991 and took silk in 2010. He was appointed a chairman of the Competition Appeal Tribunal in 2009 and was the chair of the Appeals Committee of the Human Fertilisation and Embryology Authority between 2015 and 2017. He became a High Court Judge (Chancery Division) in January 2017. In October 2017, he was authorised to sit as a judge of the Financial List.
He is the author of The Law of Assignment (2nd ed, OUP, 2013), Standards of Review and Appeal in Cases before the Competition Appeal Tribunal (Comp Law 169, 2012), co-author of Private International Law of Reinsurance and Insurance (1st ed, Informa, 2006), a contributor to Corporate Finance Law in the UK and the EU (ch 9 (security), 1st ed, OUP, 2010), Carriage by Air (chs 2,3 & 4, 1st ed, Butterworths, 2001), Bullen & Leake & Jacobs Precedents of Pleadings (Part B (assignment) and Part V (restitution), 18th ed, Sweet & Maxwell, 2015) and The Law of Bank Payments (chs 2 (money) and 4 (plastic money), 5th ed, 2012), and has published numerous articles in legal journals.
