The nature of the contempt of court in respect of which the committal order is being made:

Breach of the terms of an Injunction Order dated 29/09/05 as amended on 10/02/06, as follows:

(i)      Allowing materials to be deposited on a prohibited part of land at Graig yr Hufen, Nelson Road, Senghenydd, Caerphilly, (“the Site”), on unknown dates between 5 March 2014 and 9 April 2015;

(ii)      Allowing materials to be removed from a prohibited part of the Site on 24 June 2014;

(iii)     Allowing materials to be deposited on a prohibited part of the Site on 10 April 2015.

The punishment being imposed:

(1)     For his contempt, Clive Payne stands committed to HM Prison Cardiff for a period of 42 days.

(2)     Further, the Court activates the remaining 41-day suspended sentence to which Clive Payne is already subject pursuant to the Order of H.H. Judge Chambers Q.C. dated 8 August 2011 and the Order of H.H. Judge Keyser Q.C. dated 1 October 2012, as further suspended by the Order of H.H. Judge Seys Llewellyn Q.C. dated 20 February 2014; this suspended sentence to be activated concurrently with the 42 days mentioned in paragraph (1) above.
