Birmingham City Council -v- Omarni Bernard-Sewell

In relation to the above numbered case, on 1 December 2016 Recorder Readings sitting at the Birmingham Civil Justice Centre as a Circuit Judge of the County Court at Birmingham, sentenced the Defendant in that case, Omarni Bernard-Sewell to a suspended custodial sentence of 28 days suspended for the term of the current Injunction and any further Order of the Court for contempt of Court on breach of an Injunction Order dated  15 February 2016 and varied on 24 February.   The basis of the sentence imposed is that Ormani Bernard-Sewell:

Was in breach of the Injunction, by

  1. Associating with Tesfa Bernard-Wheeler and being in possession of a controlled drug on 29 August 2016.
  2. Entering the exclusion zone on 18 July 2016.
  3. Entering the exclusion zone on 19 July 2016.

These breaches were contrary to the terms of the Injunction Orders dated 15 February 2016 and varied on 24 February  2016  to which  Omarni Bernard-Sewell was subject.
