The application

The court heard an application by Affinity Sutton Homes Limited for the committal of Sachin Dave Bhurtun and Kevin Bhurtun to prison

  • in the case of Sachin Dave Bhurtun for disobeying the terms of a suspended committal order made on 13th January 2016 in case no B00WD060 and the terms of the injunction order made on 24th February 2016, as varied on 23rd March 2016; and
  • in the case of Kevin Bhurtun for disobeying an anti-social behaviour injunction dated 24th February 2016.

Sachin Dave Bhurtun

The court found Sachin Dave Bhurtun to be in contempt of court for having:

  • on 8th and 10th February 2016 entered the area from which he was excluded by the terms of the order made on 13th January 2016;
  • on 11th March 2016 entered the area from which he was excluded by the injunction order made on 24th February 2016 and engaged in conduct causing or capable of causing a nuisance or annoyance in breach of that order;
  • on 29th March 2016 entering the area from which he was prohibited by the injunction order made on 24th February 2016, as varied on 23rd March 2016.

The court ordered that Sachin Dave Bhurtun be committed to prison for contempt of court for a total period of 26 weeks

Kevin Bhurtun

The court found Kevin Bhurtun to be in contempt of court for having on 17th March 2016 engaged in conduct which caused a nuisance and annoyance to AB in breach of an anti-social behaviour injunction dated 24th February 2016.

The court ordered that Kevin Bhurtun be committed to prison for contempt of court for a total period of 42 days, suspended until 29th April 2017 on condition that he

  1. complies strictly with the terms of the injunction order made on 24th February 2016 as long as it remains in force; and
  2. does not during that period return to, enter or attempt to enter any part of the prescribed area defined by reference to a plan attached to the suspended committal order.
