HIS HONOUR JUDGE GREGORY:

Well, do you understand, Mr Jones, that this order is not optional – you have to obey it?

THE RESPONDENT: Yes, I do.

HIS HONOUR JUDGE GREGORY:

That is why you were arrested. Why did you breach it that night?

THE RESPONDENT: ….. (inaudible).

HIS HONOUR JUDGE GREGORY:

Because you were drunk?

THE RESPONDENT: Yeah.

HIS HONOUR JUDGE GREGORY:

Are you going to obey it from now on?

THE RESPONDENT: Yes, I am.

HIS HONOUR JUDGE GREGORY:

Well, I am going to encourage you to obey it. For this breach, I am going to sentence you to 28 days’ imprisonment, suspended upon terms that you comply with the order. Do you understand that?

THE RESPONDENT: Yeah.

HIS HONOUR JUDGE GREGORY:

You know that that means you will walk free today?

THE RESPONDENT: Yes.

HIS HONOUR JUDGE GREGORY:

But if you breach it again, they will arrest you again, you will be brought back and I shall be very put out that you have not taken this chance – you will get the 28 days and the same on top, or something similar. Do you understand that?

THE RESPONDENT: I do, yeah.

HIS HONOUR JUDGE GREGORY:

Okay. The injunction order will continue until 27th May 2017 unless you apply to have it discharged before then and you are successful.

THE RESPONDENT: How do I go about applying to the court about contesting it?

JUDGE GREGORY: Well, you will have to go and see your solicitor and discuss that – I am not allowed to give anybody any advice – but that order will continue in force.
