1. On the 8 March 2017 this court committed the following named person to prison

Ian John Thomas

2. In relation to an order dated

7 April 2016

3. which provided that the  Defendant should

  1. Provide Kevin Juke with a full copy of his file by no later than 21 days from the date of service of the order of District Judge Chapman dated 7 April 2016.
  2. Provide Kevin Juke a chronology of his firm’s actions on Kevin Juke’s professional negligence claim pursuant to the order of District Judge Chapman dated 7 April 2016.

4. the court found that he had breached  that order by

  1. The Defendant failed to provide to Kevin Juke a full copy of his file by no later than 21 days from the date of service of the order of District Judge Chapman dated 7 April 2016. The order was personally served on the Defendant on 17 August 2016, therefore the Defendant has been in contempt since 7 September 2016.
  2. The Defendant failed to provide to Kevin Juke a chronology of his firm’s actions on Kevin Juke’s professional negligence claim pursuant to the order of District Judge Chapman dated 7 April 2016. The order was personally served on the Defendant on 17 August 2016, therefore the Defendant has been in contempt since 7 September 2016

5. and imposed the following sentence(s) for those breach(es)

Breach:

    1. The Defendant failed to provide to Kevin Juke a full copy of his file by no later than 21 days from the date of service of the order of District Judge Chapman dated 7 April 2016. The order was personally served on the Defendant on 17 August 2016, therefore the Defendant has been in contempt since 7 September 2016.
    2. The Defendant failed to provide to Kevin Juke a chronology of his firm’s actions on Kevin Juke’s professional negligence claim pursuant to the order of District Judge Chapman dated 7 April 2016. The order was personally served on the Defendant on 17 August 2016, therefore the Defendant has been in contempt since 7 September 2016
Sentence:

i. 28 days imprisonment

 

 

ii. 28 days imprisonment to be served concurrently.

6. Accordingly it was ordered that(2) Ian John Thomas  be committed for contempt to Her Majesty’s Prison at(3) HMP Dovegate  for a (total) period of 28 days  or until lawfully discharged if sooner, and that a warrant of arrest and committal be issued forthwith.
