Pursuant to paragraph 13 of Practice Direction: Committal for Contempt of Court – Open Court

In relation to the above numbered case on 9th January 2017 His Honour Judge Mark Gargan sitting in the County Court at Middlesbrough as a Judge of the County Court, sentenced the Defendant, Scott Ferguson, in that case, to a custodial sentence of fourteen weeks for contempt of court on breach of an Injunction Order dated 02nd December 2016.

The basis of the sentence imposed is that Scott Ferguson:

Was in breach of the Injunction, by

  1. Being present at 8 Wren Close, Stockton-on-Tees on 07th January 2017.
  2. By reason of the breach at (1 above) Scott Ferguson was in breach of the suspended committal order made by HHJ Mark Gargan on 23rd December 2016 for six week imprisonment which was activated.

These breaches were contrary to the terms of the Injunction Order dated 2nd December 2016 to which Scott Ferguson was subject.
