On Friday 31 March 2017, when sitting as a Judge of the Chancery Division at Manchester Civil Justice Centre, I sentenced Mrs Susan Hurst, the defendant to a committal application No D30LV075 brought by Mr Thomas Bolger in the Liverpool District Registry, to a custodial sentence of 28 days suspended until 4.00 pm on Friday 5 May for contempt of court. The basis of that sentence was that Mrs Hurst had failed to comply with a subpoena dated 28 September 2016 and personally served upon her on 16 October 2016 requiring her within 8 days to lodge with the Probate Manager at Liverpool District Probate Registry the original of the last Will of her late mother, Mrs Olive Bolger, or, if she denied that the Will was in her possession, custody or power, to make an affidavit to that effect.
