1. On the 22nd February 2017 this court committed the following named person to prison

Joshua Barnes

2. In relation to an order dated

16th October 2016

3. Which provided that the Defendant should

i) Obey the terms of the Injunction

4. The court found following admissions made he had disobeyed/breached that order by

  1. On 23rd January 2017 at approximately 1245hrs, the Respondent was seen on Cleggs Lane in Little Hulton, a road from which the Respondent is prohibited from entering by virtue of paragraph 2 of the Civil Injunction Order.
  2. On 23rd January 2017 at approximately 1245hrs, the Respondent was a passenger in a motor vehicle on Cleggs Lane in Litle Hulton which drove directly towards Jane Blood, thereby engaging (or instructing or encouraging another person to engage) in conduct causing, or likely to cause alarm, harassment and/or distress, conduct from which the Respondent is prohibited by virtue of paragraph 8 of the Civil Injunction Order.
  3. On 23rd January 2017 at approximately 1245hrs, the Respondent was a passenger in a motor vehicle on Cleggs Lane when Jorden Budgen pointed two fingers at Jane Blood and moved his thumb to mimic a trigger, this being a threatening gesture towards Jane Blood, thereby engaging (or instructing or encouraging another person to engage) in conduct causing, or likely to cause alarm, harassment and/or distress, conduct from which the Respondent is prohibited by virtue of paragraph 8 of the Civil Injunction Order.
  4. On 23rd January 2017 at approximately 1245hrs, the Respondent was a passenger in a motor vehicle with Jordan Budgen on Newcombe Drive and Cleggs Lane, a person whom the Respondent is prohibited from being in company of by virtue of paragraph 7 of the Civil Injunction Order.

5. And imposed the following sentence(s) for those breach(es)

Breach: See Paragraph 4 above

Sentence: 9 months immediate custodial sentence minus 46 days for time served.

6. Accordingly it was ordered that Joshua Barnes be committed for contempt to Her Majesty’s Prison at Forest Bank for a total period of 9 months immediate custodial sentence minus 46 days for time served or until lawfully discharged if sooner.
