Committal for Contempt of Court in Open Court at the County Court sitting at Hammersmith – Saleh

|Contempt of Court

County Court at Hammersmith

On 5 January 2016, in case no. A03B0557, between the Commissioner of Police  of the Metropolis and Awadh Saleh, on hearing counsel for the claimant and the defendant having failed to attend and also having failed to comply with the terms of an order made on the adjournment of these breach proceedings on 11 December 2015, District Judge Ryan sentenced the defendant on two breaches of an injunction dated 7 May 2015, as amended on 2 November 2015, granted under the provisions of Part 4 of The Policing and Crime Act 2009 (gang related violence) to a detention order for a period of 3 months for each breach, the terms to be served concurrently.

The breaches related to prohibitions against entering an exclusion zone and being in the company of persons in respect of whom he was prohibited from associating. In imposing sentence, the court noted the fact of six earlier breaches which the court has previously dealt with and the fact that a supervision order and curfew requirement  imposed by this court on 6 November 2015 has failed to deter the defendant from committing further breaches.
