1. On the 9 February 2017 this court committed the following named person to prison

Amanda Montana

2. In relation to an order dated

9 September 2016

3.which provided that the Defendant should not [set out relevant paras of the order]

  1. The Defendant, Amanda Montana be forbidden (whether by herself or by instructing or encouraging or permitting any other person) from engaging or threatening to engage in conduct capable of causing harassment, alarm or distress or nuisance or annoyance to Matthew Griffiths of 19 Joseph Groome Towers, Ellesmere Port, CH65 2BZ or any resident or lawful visitor to Joseph Groome Towers, Ellesmere Port, CH65 2BZ to include:
  2. Playing or causing to be played, at any time, music or sound from a stereo, television or any sort of sound emitting device at such volume as to be capable of causing nuisance or annoyance to any person referred to in clause 1.
  3. Using abusive or insulting or threatening behaviour against any person referred to in clause 1.
  4. Harassing any such person referred to in clause 1.
  5. Using or threatening violence against any such person referred to in clause 1.

4. the court found that [following admissions made] she had disobeyed/breached  that order by

  1. On 2 January 2017 The Defendant, Amanda Montana caused nuisance and annoyance by banging, shouting and general noise from her property.
  2. On 3 January 2017 a visitor to the Defendant’s property shouted “Shut the fuck up, you stupid fat prick” at a local resident.  Further  nuisance and annoyance was caused by loud noise emanating from the Defendant’s property at 01:30 a.m.
  3. On 5 January 2017 at 11:15 p.m the Defendant caused nuisance and annoyance to local residents by causing loud banging noises, shouting, slamming doors and dropping objects on the floor.  The nuisance continued until 02:20 a.m.

5. and imposed the following sentence(s) for those breach(es)

Breach:
1. On 2 January 2017 The Defendant, Amanda Montana caused nuisance and annoyance by banging, shouting and general noise from her property.
2. On 3 January 2017 a visitor to the Defendant’s property shouted “Shut the fuck up, you stupid fat prick” at a local resident. Further nuisance and annoyance was caused by loud noise emanating from the Defendant’s property at 01:30 a.m.
3. On 5 January 2017 at 11:15 p.m the Defendant caused nuisance and annoyance to local residents by causing loud banging noises, shouting, slamming doors and dropping objects on the floor. The nuisance continued until 02:20 a.m.
Sentence:
1. 28 days imprisonment (suspended) to run concurrently.
2. 28 days imprisonment (suspended) to run concurrently.
3. 28 days imprisonment (suspended) to run concurrently.

6. Accordingly it was ordered that(2) Amanda Montana be committed for contempt to prison for a (total) period of  28 DAYS.

The order is suspended until 9 February 2018 and will not be put into force if during that
time(2) Amanda Montana  complies with the following terms:

Complies with the terms of the Injunction dated 9 February 2017:

  1. The Defendant, Amanda Montana be forbidden (whether by herself or by instructing or encouraging or permitting any other person) from engaging or threatening to engage in conduct capable of causing harassment, alarm or distress or nuisance or annoyance to Matthew Griffiths of 19 Joseph Groome Towers, Ellesmere Port, CH65 2BZ or any resident or lawful visitor to Joseph Groome Towers, Ellesmere Port, CH65 2BZ to include:
  2. Playing or causing to be played, at any time, music or sound from a stereo, television or any sort of sound emitting device at such volume as to be capable of causing nuisance or annoyance to any person referred to in clause 1 or smoking cannabis or allowing cannabis to be smoked within 23 Joseph Groome Towers, Ellesmere Port.
  3. Using abusive or insulting or threatening behaviour against any person referred to in clause 1.
  4. Harassing any such person referred to in clause 1.
  5. Using or threatening violence against any such person referred to in clause 1.
