On 19th January 2017 the Defendant was ordered not to attend  an address in Bird Lane Tiptree Essex or to go within 100 metres of the address.   The order was to last until 19th January 2018 and a power of arrest was attached to the order.

The order was served on the Defendant.

On 1st November 2017 the Defendant was brought before the court,  having been found on 31st October 2017 at the address in Bird Lane.      He was already the subject of a suspended prison sentence of 28 days imposed by the court on 2.10.2017 as a result of a previous breach of the order.  The sentence was to be suspended provided that the Defendant obeyed the order of 19.1.2017.

The Defendant was represented by Mr Bailey of counsel,  pro bono.     The Defendant admitted the breach.     His long standing difficulties with alcohol were at the root of his problems.

The court imposed a sentence of 28 days imprisonment for the breach of 31st October and imposed the sentence of 28 days from the order of 2.10.2017 to run consecutively.    The Defendant was therefore sentenced to 2 months in prison.
