  1. On the 6th April 2017 this court committed the following person to prison:

MISS CARLY MITCHELL

  1. In relation to an order dated 24th  November 2016 which provided that the Respondent/Defendant“1. Within 2 hours of being served with this Order must leave and not return to the area contained within and outlines by the black line on the attached Map A.
  2. must not use foul, abusive or threatening language towards any person in a public place in the Borough of Bournemouth;
    7. must not have in her possession any illegal drugs or drug paraphernalia in a public place in the Borough of Bournemouth;
    9.must not approach any member of the public and engage in conversation in a public place in order to obtain money, donation or loans within the Borough of Bournemouth.”

Breach:

  1. The court found that, following evidence, she had disobeyed/breached that order by:

On 30th November 2016 at approximately 1725 hours the defendant was seen in the Avenue Road Car Park, Bournemouth.  When she was asked to leave by the car park attendant and reminded she was banned from the Bournemouth Town centre she re[plied “yes, I’m leaving I know but they can’t ban me because I live here”.  The defendant then left the car park and headed towards The Triangle, Bournemouth. This area is in the exclusion zone.

On 1st December 2016 between 16.37 and 16.47 the defendant was seen in Old Christchurch Road and Westover Road, Bournemouth. This area is in the exclusion zone.

On 6th  December 2016 at approximately 10.20 the defendant was seen on Commercial Road, Bournemouth walking towards Poole Hill. This area is in the exclusion zone.

On 13th December 2016 at approximately 11.30 the defendant was seen walking along the pavement on Old Christchurch Road, Bournemouth. She was stopped by a police officer and the defendant said “I am leaving and I have just been to the Town Hall”.  The police officer adviser her of the terms of the injunction to which the defendant advised that she had lost her map for the exclusion zone as it had become wet. She was told to come to the police station immediately to collect a new one. She failed to do this. This area is in the exclusion zone.

On 15th December 2016 at approximately 09.49 the defendant was found asleep on the stairs of Queensbury Mansions, Bournemouth. She was woken up by police officers and told to leave, which she did. She walked onto Bath Road, Bournemouth in the direction of Amberley Court. This area is in the exclusion zone.

On 15th December 2016 at approximately 20:00 the defendant was seen in Moon in The Square Public House, Bournemouth. She was escorted out of the pub by a police community support officer who reminded her of the injunction to which she responded “I was just using the pub as a shortcut”. She was advised that she would be reported for the alleged breach and the defendant replied “yeah, I know my conditions as Robocop told me this week”. This area is in the exclusion zone.

On 28th December 2016 at approximately 18:45 the defendant was located by Dorset Police in Amberley Court, Bath Road, Bournemouth. This area is in the exclusion zone.

On 30th  December 2016 at approximately 10.50am the defendant was seen walking up Holdenhurst Road, Bournemouth. She was walking in the direction of the Landsdowne roundabout. This area is in the exclusion zone.

On 30th  December 2016 at approximately 13:15 the defendant was seen entering a vacant store of Denim Eleven on Westover Road, Bournemouth. A few minutes later she exited the property and headed down towards Bournemouth Arcade. She then crossed the road towards The Stable Restaurant. This area is in the exclusion zone.

On 15th December 2016 at approximately 09.49 the defendant was found asleep on the stairs of Queensbury Mansions, Bournemouth. She was woken up by police officers and told to leave, which she did. She walked onto Bath Road, Bournemouth in the direction of Amberley Court. This area is in the exclusion zone.

On 12th January 2017 at approximately 09:30 the defendant was located by Dorset Police in Amberley Court, Bath Road, Bournemouth. This area is in the exclusion zone.

On 18th January 2017 at approximately 0015 hours  the defendant was located by Dorset Police in at the roundabout at the junction of Lansdown Road and Madeira Road, Bournemouth. This area is in the exclusion zone.

On 14th February 2017 at approximately 0336 hours  the defendant was located by Dorset Police at the car park of Fairmount Hotel, 15 Priory Road, Bournemouth. This area is in the exclusion zone.

On 14th February 2017 at approximately 1500 hours  the defendant was seen by Dorset Police in The Square, Bournemouth. This area is in the exclusion zone.

On an unspecified date in December 2016  the defendant approached a member of the public in the street outside of Westbourne Library, Alum Chine Road, Bournemouth and asked her for money. When the member of public refused, the defendant told the lady to ‘fuck off’.

On 13th March 2017 between 0900 and 1200 hours the defendant was seen outside Tenovs Charity Shop on Poole Road, Westbourne and was heard approaching members of the public and asking for money. This occurred on several occasions.

On 27th March 2017 at approximately 1500 hours the defendant was arrested in The Triangle, Bournemouth. This area is in the exclusion zone. N addition, the defendant told a police officer she had Valium in her pocket. When searched by the police officer she had in her possession a small blue polythene bag which contained 3 wraps of suspected class A drug in blue polythene and 8 white tablets.

And imposed the following sentence for those breaches.

Sentence: 26 weeks in custody.
