In relation to the above numbered case on 21st December 2015, His Honour Judge Cooke sitting at the Birmingham Civil Justice Centre as a High Court Judge of the County Court at Birmingham, sentenced the Defendant in that case, Mr. Harry Herne, to a suspended custodial sentence of 3 months imprisonment suspended on condition that he complies with the said Order within 14 days after service of this Order, for contempt of court on breach of injunctions dated 1st April 2015 . The basis of the sentence imposed is that Harry Herne

Failed to deliver all remaining stock or account for it, and deliver up all accounting records, books and papers or company work belonging to Herne Wholesalers Ltd or provide an explanation as to the absence within 10 days of service of the Order on him on the 27th April 2015.

The breach was contrary to the terms of the injunction order dated 1st April 2015 to which Harry Herne was subject.
