Committal for Contempt of Court in Open Court at the County Court at Walsall

|Contempt of Court

Pursuant to paragraph 13 of Practice Direction: Committal for Contempt of Court – Open Court

B00WJ376: Walsall Housing Group Ltd -v- Mr Kevin Tooth

In relation to the above case on 18th May 2015, whilst sitting at the County Court at Walsall as a District Judge, I sentenced the Defendant to a custodial sentence of 14 days for contempt of Court, such sentence was suspended until 4.00pm 16th April 2016.

A prison sentence was imposed because the Defendant deliberately breached the court order and played loud music to use the Defendants own words “to piss off” his neighbour. The defendant’s behaviour did have a detrimental effect on the neighbour. The deliberate breach did require the imposition of a prison sentence but given that it was an isolated breach of the order it was suspended for the length of the injunction

Paul Watson
District Judge
