Statement from the Lord Chief Justice and the Master of the Rolls: Review of Fixed Recoverable Costs – Publication of Report

We are very grateful to Lord Justice Jackson for his comprehensive and detailed review on extending fixed recoverable costs (FRC).

His report, which is published today, was undertaken at our request in November 2016 and has been completed on time with the assistance of 14 assessors from a variety of legal backgrounds.

The report analyses ways in which the recovery of costs can be made more proportionate and so promote access to justice in civil litigation. It builds on the reforms recommended in his seminal Review of Civil Litigation Costs, published in January 2010, which both recommended fixed costs in some areas and contemplated further review to extend FRC.

In undertaking his review Lord Justice Jackson has canvassed and received views from a broad spectrum of interested parties.

The report now falls to be considered by us and the Government, which is committed to consulting before any proposals are implemented.
