Protocol for the Provision of Advance Information, Prosecution Evidence and Disclosure of Unused Material in the Magistrates’ Courts

This protocol is designed to establish firm principles for the management of advance information, evidence and disclosure in the Magistrate’s Court for police, prosecution and defence practitioners, legal advisors and the judiciary. Effective from 15th May 2006 across the four pilot sites, the protocol is regarded as best practice to ensure the administration of justice is not delayed by inappropriate or inadequate provision or applications for advance information, evidence or disclosure.

Although the current draft of the Protocol is for pilot sites, it is expected that courts and practitioners in all areas will use and refer to the document for guidance.  All users are welcome to feedback comments as it is understood there may be some areas which require revision when the pilots are concluded.
